Membership Terms and Conditions
This Membership Agreement ("Agreement") is entered into between you (the "Member") and PR Fitness Ltd, trading as The Workshop Fitness Centre (referred to as "we," "us," or "our"). By signing this Agreement, you agree to comply with all terms and conditions. If you wish to cancel your membership, you may do so within 5 business days by emailing us at theworkshop.gym.nz@gmail.com. Note that usage fees may apply.
01. Use of Facilities
Your membership grants you access to The Workshop Fitness Centre facilities, excluding additional services such as personal training, food, or beverages, which must be paid separately. We will strive to ensure availability of all equipment; however, due to demand or unforeseen circumstances, certain facilities or equipment may occasionally be unavailable.
02. Membership Duration
Membership is for the minimum period specified in your Agreement. You agree to make timely payments throughout this period, regardless of attendance. After the minimum period ends, payments will continue until you terminate your membership in accordance with section 05.
03. Fees and Payments
All membership payments are outlined in this Agreement. You are required to continue payments even if you do not attend. Membership fees are calculated on a weekly basis and may be paid through weekly direct debits or in full at the start of the contract. You must ensure sufficient funds are available, and any missed payments may result in denied access to the gym until the balance is cleared. Missed payment recovery costs, including a $5 administration charge, will be added to your account, and if overdue by more than 4 weeks, your account may be referred to a collection agency.
04. Gym Rules and Procedures
All members must adhere to gym rules to maximize the experience for everyone. Copies are available at reception and online at www.theworkshop-fitnesscentre.com. Members are expected to act responsibly, respect staff and fellow members, and follow health and safety guidelines. Photography or videography in the gym requires permission from both management and those involved. Violations may result in membership termination and liability for associated costs, including legal fees.
05. Termination by the Member
To terminate your membership within the initial term, a written notice of 30 business days is required. Requests can be emailed to theworkshop.gym.nz@gmail.com. A termination fee of 25% of the remaining balance or $150, whichever is less, will apply. All outstanding fees must be settled prior to termination. If terminating after the minimum period, a 30-day notice applies. Alternatively, you may transfer your membership to another individual for the remainder of the term, subject to a $50 administration fee.
05. Termination by The Workshop Fitness Centre
We reserve the right to terminate your membership immediately if you engage in illegal or offensive activities, breach gym rules, or miss four or more payments. In such cases, no refunds will be issued, and the standard 30-day notice period remains applicable.
06. Membership Suspension
Members may suspend their membership for a minimum of 2 weeks during the initial term, extending the term by the suspension period. After the initial period, memberships may be paused for up to one month per year. Additional pauses incur a $5 weekly hold fee. If gym access is needed during the suspension, payments will resume as of the initial payment date.
07. Membership Cancellation
Following the initial term, memberships may be canceled with 30 days' notice in writing, either by email or in person. Written confirmation of the cancellation will be provided within seven days.
08. Government Mandates and Health Requirements
In compliance with New Zealand Government directives (e.g., in the event of a pandemic), proof of meeting any mandated health requirements may be required. This information will be securely stored in line with our Privacy Policy.
09. General
We reserve the right to amend this Agreement with one month's notice. It is your responsibility to use our facilities safely, protect your personal health, and safeguard your belongings. Personal injury by accident is covered under New Zealand’s Accident Compensation Act.
Gym Rules
To maintain a positive environment, members must comply with the following rules. Failure to adhere to these may lead to restricted access or membership termination:

Treat all equipment and facilities with respect; you are liable for any damage caused by negligence or intent.

Respect all members; harassment, intimidation, or discrimination will not be tolerated.

Do not bring valuables, and refrain from allowing unauthorized individuals to access the facility.

Certain exercises, such as bench presses or squats, require safety measures like bar safeties or a training partner.

Return all equipment and weights to their designated places, and wipe down any gear after use.

Alcohol, drugs, smoking, and vaping are strictly prohibited on or near the premises.

Only Workshop-certified trainers may conduct personal training sessions; violation may result in immediate contract termination.

Tripods, bags, and other personal items should be stored appropriately and not placed on the gym floor without permission from management.
The Workshop reserves the right to modify these rules at any time. Please follow all guidelines to ensure a positive environment for everyone at the facility.

This Privacy Policy outlines how PR Fitness Ltd, trading as The Workshop Fitness Centre (“we,” “us,” “our”) collects, uses, and protects your personal information. By joining The Workshop Fitness Centre and utilizing our services, you consent to the practices described in this policy. We may also gather information from third-party sources (e.g., payment providers) if necessary to facilitate your membership and access to our facilities.
2. Use of Information
Your personal information is used solely to deliver our services and improve your experience at The Workshop Fitness Centre. Specifically, we may use your data for:

We will only contact you with promotional offers if you have opted in for such communications, and you can opt out at any time.

Your personal information is stored securely on our systems, with appropriate technical and organizational measures in place to protect against unauthorized access, loss, or misuse. Only authorized personnel have access to your information, and we regularly review our data security practices to ensure your information remains safe. We retain personal data only as long as necessary for the purposes set forth in this policy, or as required by law.
5. Member Access and Rights
As a member, you have the right to:

6. Government Health Mandates and Special Circumstances
During periods where health mandates apply (e.g., COVID-19), we may be required to verify health information, such as vaccination status, as a condition for facility access. We will handle this data with the highest level of confidentiality and in compliance with New Zealand’s Privacy Act. Such information is securely stored and only accessible by authorized personnel for as long as required.
7. Updates to this Privacy Policy
We reserve the right to amend this Privacy Policy as necessary. Any changes will be communicated to you via email or through in-facility notices. It is your responsibility to review these updates. Continued membership or use of our facilities after changes are made constitutes acceptance of the updated policy.
